These Terms of Service (the “Terms”) govern your use of the MyTrashValet website located at mytrashvalet.ca (the “Site”) and any related online services we provide through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Who We Are
The Site is operated by 17236492 Canada Inc.
We are a Canada Inc. corporation that provides door to door collection of garbage, recycling, organics and certain bulky and electronic waste for apartment and condo communities in the Greater Toronto Area (the “Services”).
The Site is intended to provide information about our Services and to allow property managers, building owners and condo boards to contact us, request information or begin the process of setting up service for their building.
Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not use the Site in any way that could damage, disable, overburden or impair the Site or interfere with any other party’s use of the Site.
No Service Offer or Guarantee
Information on the Site, including descriptions of Services, service areas, building types and any references to pricing, schedules or features, is provided for general information only. Nothing on the Site is a binding offer. Service availability, scope, pricing and schedule are always subject to a separate written service agreement between MyTrashValet and the relevant property manager, building owner or condo board (a “Service Agreement”).
Eligibility
The Site is intended for users who are at least the age of majority in their province or territory of residence. By using the Site, you represent that you meet this requirement and that you are acting on behalf of yourself or an organization you are authorized to represent.
Accounts, Forms and Information You Provide
The Site may allow you to submit information through forms (for example, “Contact Us” or “Request a Quote”) or other input fields. You agree to provide accurate, complete and current information and to update it if it changes. You are responsible for any information you submit through the Site.
Building Service Agreements
MyTrashValet contracts directly with buildings, including apartments and condos, through property managers, owners, condo boards or other authorized representatives. All commercial terms related to the Services, including but not limited to:
a) what materials are collected, including garbage, recycling, organics, bulky items and e waste
b) pickup days, times and frequencies, including regular schedules (for example, three nights per week such as Monday, Wednesday and Friday, and Saturday morning pickups)
c) changes to service for holidays or building closures
d) pricing, billing and payment terms
e) contract length, auto renewal, suspension and termination
are governed by the applicable Service Agreement. If there is any conflict between these Terms and a Service Agreement, the Service Agreement will control, but only as it relates to the Services provided under that agreement.
Service Scope and Restrictions
The Services generally involve door to door collection of waste from participating units within a building and transport of that waste to the building’s designated collection or disposal area. Actual service details vary by building and are described in the applicable Service Agreement and any building rules or guidelines.
Certain materials may be restricted or prohibited by building policies, municipal bylaws or provincial or federal law. Without limiting the generality of the foregoing, we may refuse to collect any item that we reasonably consider unsafe, non compliant, excessively heavy, hazardous or otherwise inappropriate for collection. Prohibited materials may include, for example, chemicals, solvents, paints, oils, construction debris, medical sharps and other hazardous or regulated waste. Prohibited or restricted items may be further defined in a Service Agreement or building specific Service Guidelines.
User Responsibilities
When you use the Site, you agree that you will not:
a) use the Site for any unlawful, fraudulent or harmful purpose
b) attempt to gain unauthorized access to any part of the Site, to other accounts or to computer systems or networks connected to the Site
c) upload, post, transmit or otherwise make available any viruses, malware or other harmful code
d) use any robot, bot, scraper, spider or other automated means to access the Site for any purpose without our prior written permission
e) impersonate any person or entity or misrepresent your affiliation with any person or entity
f) interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available
Quotes, Estimates and Pricing Information
If you request a quote or estimate through the Site, you understand that:
a) any pricing information provided is an estimate only and is subject to change
b) final pricing, billing frequency and payment terms are confirmed only in a Service Agreement or in writing from MyTrashValet
c) taxes and any additional fees may apply based on factors such as building size, number of units, service frequency and scope of materials collected
Service Modifications and Interruptions to the Site
We may update, modify, limit, suspend or discontinue any part of the Site at any time without notice. We do not guarantee that the Site will be available at all times or free from errors or interruptions. We are not liable for any loss or damage that may result from any modification, suspension, discontinuation or unavailability of the Site.
Intellectual Property
All content on the Site, including text, graphics, logos, icons, images and the overall design and layout, is owned by or licensed to MyTrashValet and is protected by applicable copyright, trademark and other intellectual property laws. You may view and print content from the Site for your personal, non commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display or otherwise exploit any content from the Site without our prior written consent.
Third Party Links
The Site may contain links to third party websites or services that are not owned or controlled by MyTrashValet. We do not endorse and are not responsible for the content, policies or practices of any third party websites or services. Accessing any third party links is at your own risk and subject to the terms and policies of those third parties.
Privacy
Your use of the Site may involve providing personal information. Our collection, use and disclosure of personal information are governed by our Privacy Policy, which is available on the Site. By using the Site, you consent to our handling of your personal information as described in the Privacy Policy.
Disclaimer of Warranties
The Site and all content on the Site are provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. To the fullest extent permitted by law, MyTrashValet disclaims all warranties, whether express, implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non infringement. We do not warrant that the Site will be error free, secure or uninterrupted, that defects will be corrected or that the Site or the servers that make it available are free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, MyTrashValet, its directors, officers, employees, contractors and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from or in connection with:
a) your access to or use of, or inability to access or use, the Site
b) any conduct or content of any third party on or related to the Site
c) any content obtained from the Site
d) unauthorized access, use or alteration of your transmissions or information
In any case, our total cumulative liability to you for any claim arising out of or relating to these Terms or your use of the Site will not exceed one hundred Canadian dollars (CAD 100).
Indemnification
You agree to indemnify, defend and hold harmless MyTrashValet, its directors, officers, employees, contractors and agents from and against any and all claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with:
a) your use of the Site
b) your violation of these Terms
c) your violation of any rights of another person or entity
Governing Law and Disputes
These Terms and your use of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Site will be brought exclusively in the courts located in Ontario. You agree to submit to the personal jurisdiction of those courts and waive any objection to jurisdiction or venue in such courts.
Before commencing any formal legal proceeding, you agree to first contact us at help@mytrashvalet.ca
and give us a reasonable opportunity, not less than thirty days, to try to resolve the dispute informally.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after any changes are posted means that you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
